Court Dismisses Case Against Appointment of IEBC Selection Panel

The High Court has dismissed a case that sought to stop the appointment of members to the IEBC selection panel, saying the case lacked enough evidence.

The petition, led by activist Okiya Omtatah and three others, claimed the selection process was unconstitutional and lacked transparency. However, Justice Mugure Thande ruled that the petitioners failed to prove their claims.

“The court cannot act on assumptions or speculations,” the judge said, adding that there was no strong evidence showing that any laws were broken during the appointments.

This ruling now allows the selection panel to continue with its mandate of recruiting new IEBC commissioners, a process that began after several officials left following the 2022 General Election.

The petitioners had argued that the process lacked public participation and fairness. But the court found that the appointments followed the law and no constitutional rights were violated.
